Infant genital surgery case brought by family of M.C., a Black intersex child operated on while in the foster care system

M.C. is an African American child born with an intersex variation, ovotesticular syndrome, wherein both gonads have ovarian and testicular tissue. At 16 months old, surgeons at Medical University of South Carolina subjected M.C. to medical harm by creating a vagina and removing one of his gonads. M.C. was eventually adopted by Pam and Mark Crawford and started to identify as male. The Crawfords sought legal counsel to get justice for their son.

In a landmark case, Advocates for Informed Choice (AIC), now interACT: Advocates for Intersex Youth, the law offices of Kenneth Suggs, the Southern Poverty Law Center, and Steptoe and Johnson LLP filed a lawsuit against the South Carolina Department of Social Services, the Medical University of South Carolina, and the Greenville Hospital System on behalf of M.C.

The case settled four years later for $440,000.
